Submission Form and Right to Reproduce My Photo(s)

To the Johnny Appleseed Trail Association (JATA), I agree to grant all rights, for all print, electronic, and any other media, to reproduce the photo(s) that I am hereby submitting to www.appleseed.org. I authorize the Johnny Appleseed Trail Association, its assigns and transferees to copyright, use and publish the same in print or electronically.

I agree that the Johnny Appleseed Trail Association may use such photos with or without my future permission for any lawful purpose, including for example, such purposes as publicity, illustration, advertising, and Web content.

I am over 18 years of age, and am able to enter into a contract. If I am a minor, I have informed my parent or guardian of my intention to submit the photo(s) and have received permission. The grantor of the photo reproduction rights will be judged to be the authorized account holder of the e-mail address submitted at the time of submission, provided that such person is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

JATA assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submissions. JATA is not responsible for electronic transmission or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed or misdirected, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by JATA on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Photo Gallery or the downloading or accessing of any materials in this Photo Galley. JATA is further not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Photo Gallery for any technical or human error, which may occur in the transmission, receipt or processing of photos. Photos not conforming to common standards of taste will not be considered for inclusion.

Any attempt to deliberately damage any website or undermine the legitimate operation of the Photo Gallery may be a violation of criminal and civil laws and should such an attempt be made, JATA reserves the right to disqualify and seek damages or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
